Terms and Conditions

These are the standard Terms and Conditions (T&Cs) for working with The Scarlet Paw Print. Please take the time to read them and ensure you fully understand them and their implications before you commence any project with The Scarlet Paw Print.

Work Commencement

Agreement to work with, submission of a design brief and payment of deposit to The Scarlet Paw Print constitutes agreement to these T&Cs and you will be asked to acknowledge your agreement at the start of a project.

Deposit and Payment

As the client, you agree to pay a 50% deposit of the agreed quoted amount in order for The Scarlet Paw Print to commence any research or work on a design project, with the remaining 50% balance payable prior to delivery. Once research or design work has commenced on a project, this deposit is non-refundable. In the case of a change of mind by you, as the client, this deposit is non-refundable.

The Scarlet Paw Print will always endeavor to provide web and graphic design services that exceed a client’s expectations, but in the event of a “change of mind” (after a project has commenced) by you, the client, the initial 50% deposit is forfeited, plus a pro-rata payment based upon the time already spent on the project.

If the work time exceeds 6 calendar weeks in duration, then a progress payment of 50% of the balance per month until the conclusion of the project is required, with any outstanding amount payable in full upon delivery.

All invoices must be paid in full prior to files being released to a printer (graphic design) or uploaded onto the internet (web design).

Late Fees

Invoices which are not paid by their due date will incur a late administration fee of GPB£10.00.  Invoices which remain outstanding for 14 days after the date of invoice will incur an additional late payment fee equivalent to 5% of the project fee for each week payment is outstanding. If you are having difficulty paying your invoice, please get in touch as soon as you are aware of the issue, so we can discuss a solution that works for your company.

Design Samples and Credits

Wherever possible, we would ask that you supply The Scarlet Paw Print FOC a number (to be agreed mutually) of printed samples of every item designed for you, the client during the project.

In the case of web design you, the client, agree to allow a small credit in the footer of all pages of your website with a link to the front page at thescarletpawprint.com. Removal of this credit constitutes a breach of these T&Cs.

You, the client, also agree to allow The Scarlet Paw Print to showcase any/all work created in the course of a project as part of The Scarlet Paw Print portfolio. The Scarlet Paw Print acknowledges the confidential nature of projects and agrees to only promote designs once the product or site has been publicly launched or commenced.

Fees For Service

It is agreed that the fees for service shall be the cost estimates provided via email, unless work undertaken exceeds the work outlined. If work undertaken exceeds the items specified in the quote, you, the client, agree to pay appropriate fees for the excess work, outside the scope of the original agreement. You, the client, will always be notified of increases in the scope of the project in order to make a decision if you would like to go ahead with the additional work.

Additional Work

This is defined as any work involving additions to the items listed in the Project Proposal or changes to all pieces of finished artwork after final sign off by you, the client.

From time to time extra design requirements are needed during a project, or extra files requested upon completion of a project.  Where this is the case, you the client, will be advised that the alterations or changes requested fall outside the scope of the original estimate. If you still wish these alterations to be made you must agree in writing, and a fee of GBP£60 per hour will be payable.

All additional costs will be added to the final invoice, payable prior to delivery of design files.

Approval Of Final Artwork

You, the client, are responsible for final proof reading and approval of all final copy prior to the production of artwork. While The Scarlet Paw Print takes all care to avoid errors, you, the client are wholly and fully responsible for typographical errors, spelling mistakes, or incorrect information on any project committed to print or production.  The written approval by you, the client, shall be conclusive as to the approval of all artwork prior to their release for printing, implementation or installation. No refunds or reprints are given after a final approved design has gone to print due to proof reading oversights.

Printing Errors and Colour Variations

It is agreed that The Scarlet Paw Print is not responsible or held liable for any errors contained in the final product after the final product has been approved by you, the client in writing.  It is the responsibility of you, the client, to notify The Scarlet Paw Print of any such errors during the revision cycle and before the final files have been generated.

With all printing there may be some colour variations from what you have seen on screen, to what the final product looks like. This is due to the nature of CMYK printing and bulk-run printing systems. In the case of unexpected colour output  The Scarlet Paw Print will not be responsible for any re-print expenses.

Artwork Delivery

Artwork will only be delivered electronically and is not available on a CD/DVD or USB stick.

Copyright

The Scarlet Paw Print retains full ownership of design concepts and materials it produces. Once a final concept is delivered to you, the client and full payment is received, complete ownership rights to the concept automatically transfer to the client. Unused concepts remain the property of The Scarlet Paw Print. The Scarlet Paw Print may still use paid-for concepts in its promotional materials and in its design portfolio.

Unless you, the client, requests otherwise, The Scarlet Paw Print may display a small byline claiming design credit on printed design work, except for corporate stationery.

This granting of copyright does not extend to the use of design proposals and concepts submitted to but not approved for the work outlined. Until final payment The Scarlet Paw Print retains ownership of all artwork and website architecture. The Scarlet Paw Print reserve the rights to certain elements used to create your images including fonts, patterns, stock images, textures, colour palettes and other non exclusive items.

Web Design Browser Compatibility

  • Internet Explorer- version 7 up to current full release (we do not support IE6)
  • Firefox 3 up to current full release
  • Apple Safari- version 4 up to current full release

Resending Uploading Files

If you, the client, require additional copies of the original completed files after the completion of the project, The Scarlet Paw Print will resend the files for a fee of GBP£20 per request.

Website Design Post-Completion Alterations

Once a web design is complete, The Scarlet Paw Print will provide you, the client, with the opportunity to review the resulting work. The Scarlet Paw Print will make one set of minor changes at no extra cost within 14 days of the start of the review period. Minor changes include small textual changes and small adjustments to placement of items on the page. It does not include changes to images, colour schemes or any navigation features. Any minor changes can be sent to The Scarlet Paw Print by e-mail. It will be considered that the original draft has been accepted if no notification of changes is received in writing from within 14 days of the start of the review period. An hourly fee after this time for tweak and amendments is payable of GBP£60.00 per hour.

Confidentiality

It is agreed that The Scarlet Paw Print shall not at any time, either during the process of the work outlined or thereafter, except in the course of their duties, divulge any of the confidential affairs of you, the client, without the consent in writing.

Liability & Litigation

It is agreed that you, the client, may, lawfully use all work and materials provided by The Scarlet Paw Print, without infringing upon the rights of others.

Termination Policy

From time to time circumstances beyond the control of either party may result in the need for project cancellation. In the event of the client cancelling a project after a project has commenced, the advance payment (deposit) will be forfeited in lieu of compensation to The Scarlet Paw Print. This is to cover design and administration time spent, resources purchased and allocated, research time and administration costs. If the project is more that 50% completed (this is determined by The Scarlet Paw Print and the client by negotiation) a pro-rata payment is payable for time spent up until cancellation notice, at an hourly rate of GBP£60.00 per hour.

If, due to unforeseen circumstances, a project is cancelled by The Scarlet Paw Print, the deposit and any other additional payments made to date, will be refunded in full to the client in a timely manner.

Amendments To These Terms And Conditions

All and any amendments to the T&Cs outlined here must be agreed and a T&Cs amendment signed by both parties prior to the commencement of work outlined in this submission.
